General Terms and Conditions

§ 1 Scope of application

The following General Terms and Conditions (GTC) apply to all services and deliveries of Finca Genie Mallorca S.L. to consumers. The terms and conditions apply to natural persons as well as to companies. All conditions deviating from our conditions of sale are recognized, provided that we have previously agreed to them in writing.

§ 3 Type of conclusion of the contract

The contract is concluded when the customer makes the down payment of the total gross amount indicated in the offer to the bank account indicated. Upon receipt of the deposit, the customer will receive an invoice in Spanish. The payment of the deposit and the resulting commencement of the contract establishes that the full amount stated on the quotation must be paid once the work has been completed. The full amount of the offer can only differ if it is described in the offer that it will be recalculated according to the actual hours worked and thus increase or decrease the price. By making a down payment, the customer agrees to this.  The customer will receive a pro forma invoice, which will be replaced by an official invoice as soon as it has been paid.

§ 4 Right of withdrawal

If you place an order as a natural person and do not use it for a commercial or self-employed activity, you have a right of withdrawal in accordance with the statutory provisions. You have the right to cancel an order within 7 days without giving reasons. You must bear the costs of the return shipment. The down payment made for orders or orders placed by service remains with the contractor and a further 30% of the total amount is due as compensation for loss.

§ 5 Shipping costs and prices

Shipping costs, delivery costs and prices are net amounts and are shown in the offers plus 21% IVA (value added tax). All costs are worked out individually in the offer.

§ 6 Method of payment

We accept the following methods of payment:

Bank transfer to the named company account with indication of the intended use.

§ 7 Retention of title

The goods remain the property of Finca Genie Mallorca S.L. until payment has been made in full.

We must be granted free access to the goods until full payment has been made.

§ 8 Special regulation

Depending on the quality of the mattress, cleaning the mattress may result in exposed threads being sucked in and thus pulled out. The customer will be informed of this verbally on site in accordance with our General Terms and Conditions. Finca Genie Mallorca S.L. accepts no liability for this. In the event of such damage during a free trial demonstration, the damage incurred will be logged and recorded and forwarded to our insurance company.

In the offer, the customer will be informed of the GTC's and their validity in the agreed language*. The customer is entitled to ask for a translation of our GTCs from our homepage. Our T&Cs can only be found on this website and can be sent directly to the desired customer e-mail address on request. *We use the languages German, English and Spanish and assume no liability for other languages.
